Policies, Terms and Conditions of Sale
PRIVACY:
Harris Hardware is committed to ensuring the privacy of our customers. Harris Hardware will not give, sell, or in any way redistribute personally identifiable information to any third party unless we are legally required to do so. All personal information you submit to us (when placing an order) is encrypted using industry-standard SSL encryption to protect data transmissions.
ORDERS:
Orders for "in-stock" items placed by 11:00 AM (Eastern Time, Monday to Friday) that will be shipped Next Day, Second Day, or Third Day usually ship the same day. Orders for "in-stock" items that will be shipped by Ground usually ship within three to five business days. Orders placed over the weekend, during holidays or factory shut-downs will not be processed until the following business day.
TITLE & RISK OF LOSS:
Title and risk of loss shall pass to Buyer on delivery of goods to a carrier selected by Seller or a carrier requested by Buyer. Buyer shall accept and inspect all shipments immediately upon arrival and shall file claims with or against the carrier for any losses, shortages, or damages of any kind. All claims including shortages, must be filed in writing within 10 days after receipt of goods.
DELAYS:
Specified delivery dates are subject to availability of material and labor. Seller shall not be liable for, and at its election, shall be excused from performance of orders if its failure to perform is due to fire, flood, acts of God, explosion, labor difficulties, mechanical breakdown, accidents, prior commitments, priority of Government orders, or any other cause beyond Seller's control. Any such reasons for delay shall extend the time for performance of the order by the number of days required to correct the cause of delay.
RETURNS:
Material made to order is not returnable. Stock material is only returnable when permission has been granted by Seller. Shipping charges on all returned goods must be prepaid. We require invoice number and date of sale with returned goods, and permission for return must be requested in writing within 30 days after receipt of merchandise.
ORDER ACCEPTANCE – QUOTATIONS:
Seller reserves the right in its sole discretion to refuse acceptance of any order from any source at any time. Quotations are valid for a period of thirty (30) days from the date of issue. Orders based on quotations which are more than thirty (30) days old shall not be accepted unless and until the original quotation is confirmed.
PAYMENT TERMS:
Visa, Mastercard and American Express are accepted. In the event that Seller takes any action to enforce its legal rights in connection with any sale and purchase, or to collect any sums due therefrom, the Buyer shall pay all cost of any such action, including, but not limited to, reasonable attorneys fees and costs, and reasonable attorneys fees and costs on appeal.
Product Selection Your placement with Harris Hardware of an order for products constitutes your acceptance of Harris's offer of sale and your agreement to these terms and conditions of sale. These terms and conditions shall be governed by the laws of New York (without reference to choice of law principles) and may not be changed except by Harris's express written agreement. Notwithstanding any oral or written information, opinions, catalog descriptions or advice furnished by Harris or its employees at any time, you, the Buyer, have sole responsibility to evaluate and test Harris's products so you can select those that are suitable for use in your specific applications.
Limitation of Liability; Release Except to the extent of the Limited Warranty and Remedy above, Harris is not and shall not be liable to you for any claims, liabilities or damages of any kind whatsoever (including without limitation direct, indirect, compensatory, special, consequential, incidental or punitive damages) arising out of Harris's provision of products to you. By purchasing products from Harris, you expressly release Harris from all such claims, liabilities and damages.
Errors; Photo & Color Disclaimer Harris reserves the right to correct any clerical or typographical errors in on the web site or in our catalogs at any time. Product photographs and color shown herein are rendered as accurately as processes permit. While we have made every attempt to accurately portray each product, Harris disclaims any liability for variations in photographic accuracy or color as compared to the actual product.
Limited Warranty and Remedy If products shipped do not conform to your specifications, or if, after use by you, the original Buyer, the products prove to be defective, Harris will, as the exclusive remedy, at Harris's option, either replace the non-conforming or defective products or issue a credit at their net invoice price. This limited warranty shall not apply if (a) we do not receive written notice of the non-conformity or defect from you within 15 days after you receive the products, (b) you do not return the non-conforming or defective products to us in their original packaging within 20 days after you receive the products or (c) the products are custom-made for you or are other special products. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED AND STATUTORY, INCLUDING (WITHOUT LIMITATION) THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, CUSTOM OR USAGE OF TRADE.
ACCEPTANCE OF ORDERS:
Acceptance of Buyer's order is expressly limited to and made conditional upon the terms and conditions contained herein, and any of the Buyer's terms and conditions which are in addition to or different from those contained herein which are not separately agreed to in writing by Seller are hereby objected to and shall be of no effect.
Prices are subject to change without prior notice and are F.O.B. our factory.
